These Terms of Service ("Terms") govern your use of the BookSmarter AI website and services. By using our website, requesting a consultation or opting in to our text messages, you agree to these Terms. If you do not agree, please do not use our website or services.
Our services
BookSmarter AI designs, builds and supports AI-powered automations for small businesses, including missed-call text-back, online booking and reminders, AI receptionists, lead follow-up, review requests and connected workflows. The specific scope, pricing and timeline of any project will be set out in a separate written proposal or agreement, which controls if it conflicts with these Terms.
Consultations and bookings
Consultation requests submitted through our website are requests, not confirmed appointments, until we confirm them by email or text message. We may reschedule or decline a request. Please let us know as early as possible if you need to cancel or reschedule.
SMS messaging terms
- Program: BookSmarter AI Appointments. When you opt in on our booking form, you agree to receive text messages from BookSmarter AI about your consultation request, including confirmations, appointment reminders and customer care messages.
- Frequency: Message frequency varies based on your appointments and requests.
- Cost: Message and data rates may apply, depending on your mobile plan.
- Opt out: Reply STOP to any message to cancel. You will receive one final message confirming you've been unsubscribed. To opt back in, reply START or submit the booking form again with the consent box checked.
- Help: Reply HELP for assistance, or contact us at hello@booksmarterai.com or (626) 404-6033.
- Carriers: Mobile carriers are not liable for delayed or undelivered messages.
- Consent: Consent to receive text messages is not a condition of purchase.
- Privacy: Your information is handled as described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
Use of the website
You agree to use our website only for lawful purposes and to provide accurate information when you submit a form. You may not attempt to disrupt the website, gain unauthorized access to it, or use it to send spam or harmful content.
Intellectual property
The content of this website, including text, graphics and logos, belongs to BookSmarter AI and may not be copied or reused without our written permission. Ownership of automations built for a client is set out in that client's project agreement.
Disclaimers
Our website and its content are provided "as is" for general information. Results from automation depend on many factors, and we do not guarantee any specific increase in bookings, revenue or other outcomes.
Limitation of liability
To the fullest extent permitted by law, BookSmarter AI is not liable for any indirect, incidental, special or consequential damages arising from your use of our website or services. Our total liability for any claim relating to the website is limited to one hundred U.S. dollars ($100), unless a separate written agreement says otherwise.
Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules.
Changes to these Terms
We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top of this page. Continued use of our website after an update means you accept the revised Terms.
